The Maine Department of Professional and Financial Regulation – Bureau of Consumer Credit Protection is seeking a Consumer Credit Examiner.
This is professional services work involving the examination of non-bank consumer lenders, granters of consumer credit, and other providers of consumer financial services including mortgage companies, personal loan companies, new and used automobile dealers that offer financing, sales finance companies, debt collectors, repossession companies, money transmitters, and credit reporting agencies. An employee in this classification may work as an examiner in charge, or with large complex institutions, as an assistant to an upper-level examiner. Responsibilities include performing compliance examinations to determine compliance with state and federal consumer credit and collection laws, preparing written reports of examination, and developing evidence for subsequent administrative action when necessary. Additional responsibilities include investigating and responding to consumer complaints, meeting with creditors and advising them on compliance issues, and recognizing compliance trends to help shape Bureau outreach efforts. This is primarily a field position and will require regular travel. Work is performed under general supervision.
Primary responsibilities include:
+ Examines records and accounts of consumer lenders, granters of consumer credit, and other companies subject to Bureau jurisdiction in order to verify compliance with the law and departmental regulations.
+ Audits Truth-in-Lending disclosures, interest postings, annual percentage rate calculations, rates on refinancing contracts, and interest rates on loans and credit sales in order to verify that the maximum amounts allowed by law are not exceeded.
+ Reviews consumer credit and lending contracts in order to identify prohibited provisions.
+ Conducts exit interviews with lenders and creditors and speaks to groups of creditors in order to increase compliance by explaining consumer credit laws.
+ Calculates statistical data in order to prepare a variety of summary reports and analyses.
+ Suggests and advocates for revisions to examination forms and procedures in order to improve efficiency and to stay current with changing state and federal laws, regulations, and policies.
+ Acts as examiner in charge for certain compliance examination in order to ensure that work is properly organized, completed, and that consolidated report is prepared for review by senior staff.
+ Discusses findings of examinations with senior management of consumer financial services business in order to resolve discrepancies, effect corrective action, and provide appropriate information.
+ Testifies at Bureau hearings in order to provide evidence based on examination findings.
+ Counsels creditors concerning business procedures and practices in order to ensure compliance with consumer laws.
+ Investigates and mediates consumer complaints regarding violations of the Maine Consumer Credit Code including Truth-in-Lending, Fair Debt Collection Practices Act, Fair Credit Reporting Act, and other statutes within the Bureau’s purview in order to enforce the laws and resolve disputes between creditors and consumers.
To be successful in the position, you must have knowledge of and experience in:
+ Knowledge of lending practices relating to loans and credit sales.
+ Knowledge of consumer credit laws.
+ Knowledge of basic accounting practices, principles, and procedures.
+ Ability to communicate effectively.
+ Ability to deal tactfully with people.
+ Ability to perform basic arithmetic functions.
+ Ability to obtain facts from consumers concerning complaints.
+ Knowledge of Bureau examination and audit procedures.
+ Knowledge of operating procedures of other regulatory agencies within the Department.
+ Knowledge of Bureau’s process for recording expenses and for billing reasonable costs to creditor for reimbursement.
+ Knowledge of Consumer Financial Protection Bureau releases and other information from federal sources.
+ Ability to prepare well-written, clear reports of examination.
+ Ability to analyze loan and credit sale transactions.
A four (4) year combination of experience and/or education in consumer credit field, e.g., compliance, economic, legal, paralegal or accounting education or background; employment in the lending or retail credit-granting field; or other related education or occupation.
